Well…l I know in these parts promoters constantly use pictures of celebrities that aren’t going to be at their events to get a boost. A lot of times it doesn’t make a difference. You could put Jesus on the flyer. If the work is not put in, the party will flop. I would believe that’s why Machel is filing this lawsuit. Could it be a bit too late though? Did these guys at least discuss making this a possibility. Where was the miscommunication, What do you think?
SOCA star and 2016 Road March winner Machel Montano will be taking former national footballer Dwight Yorke to court as he seek damages after he was falsely advertised as being one of the performers at Yorke’s annual Island Vibe fete in Tobago over the weekend.
This was revealed yesterday during a court hearing at the Hall of Justice in Port of Spain in which Montano was seeking an injunction to prevent Yorke from further using his name and image in the advertisements to promote the event which took place on Saturday at Pigeon Point.
That same afternoon, Montano obtained an emergency order which was granted by Justice Ricky Rahim which restrained Yorke from promoting, advertising or publishing the alleged performance or any of his bands at the event.
The substantive issue came up for hearing before Justice Frank Seepersad yesterday. When the matter was called, Justice Seepersad stated that the whole purpose of the application was to prevent Yorke from further using Montano’s image to promote the event. However, given that the event had already taken place, the judge said it would serve no use in the matter proceeding and granted leave to Montano’s team of attorneys which was led by Larry Williams, to withdraw the notice of application for the injunction.
However, even though the application was withdrawn, Montano will still be taking legal action against Yorke for damages after his name and image was used to promote the event. Williams indicated to the court that when attorneys sought to serve Yorke with the relevant documents to initiate court proceedings for damages, they were told by his brother, Gary, that Yorke “was on a plane to England.” A date for the trial to begin will only be set when Yorke is served and files his defence. Montano was also absent in court after he too, was said to be bout of the country.
